MEDALITE APP TERMS AND CONDITIONS

Welcome to Medalite. These Terms & Conditions (“Terms”) govern your use of the Medalite mobile app, LED mask, and all related products and services provided by Medalite, Inc. (“we,” “us,” or “our”).
By using the App or device, you agree to these Terms and to the Medalite Safety Waiver & Consent Agreement (“Waiver”).
If you do not agree, please discontinue use immediately.
1. Relationship Between These Terms and the Safety Waiver
The Waiver governs safe physical use of the Medalite LED Mask.
These Terms govern the App, digital services, and software.
You must review and accept the Waiver before using any light sessions or hardware.
If a conflict arises between the two, the Waiver controls matters of physical device use and health safety.
Both documents apply together and are enforceable under Utah law.
2. Eligibility & User Confirmation
To use Medalite, you must:
Be 18 years of age or older;
Meet all requirements listed in the Safety Waiver & Checklist;
Be capable of entering a legally binding agreement.
By continuing to use Medalite, you confirm that these statements are true.
3. General Wellness Disclaimer
Medalite is a general wellness and meditation tool intended to support relaxation, focus, and self-reflection.
It is not a medical device, has not been evaluated by the FDA, and is not intended to diagnose, treat, cure, or prevent any disease or mental health condition.
Individual results vary. Some users may experience vivid visual effects or deep relaxation; others may not.
Do not combine Medalite sessions with psychoactive substances or medications unless directed by a licensed clinician.
4. Safety Requirements & Contraindications
You agree to use the device only if all statements in the Waiver’s Mandatory Safety Checklist are true, including (but not limited to):
No personal or family history of epilepsy or seizures;
No photosensitivity, blackouts, or neurological conditions;
Not pregnant or breastfeeding;
Not taking medications that lower seizure threshold without medical clearance;
Not experiencing psychosis, severe panic, or suicidal ideation.
Always use the device seated or lying down with eyes closed, beginning with low brightness and short durations.
Immediately stop if you experience dizziness, discomfort, or anxiety.

5. Accounts & Use of the App
To access certain features, you may create an account using your email or Apple/Google login.
You agree to:
Provide accurate, up-to-date information;
Maintain the confidentiality of your credentials;
Use the App only for lawful purposes.
We reserve the right to suspend or terminate accounts for misuse, safety violations, or breach of these Terms or the Waiver.
6. Payments & Subscriptions
Some features require in-app purchases or subscriptions.
Payments are processed securely via Stripe, Apple, or Google Play — Medalite never stores payment card data.
Subscriptions renew automatically unless canceled at least 24 hours before renewal.
Refunds follow Apple or Google Play policies.
7. Assumption of Risk & Release of Liability
You understand that flickering-light devices involve inherent risks, including but not limited to seizures, dizziness, emotional distress, or visual disturbances.
By using Medalite, you voluntarily assume all risks and agree to the Release of Liability contained in the Safety Waiver.
You acknowledge having read, understood, and accepted the Safety Waiver before using the device.
To the maximum extent permitted by Utah law, you release and hold harmless Medalite, Inc. and its affiliates from any claims arising from ordinary negligence or failure to follow instructions.
This does not limit claims for gross negligence or manufacturing defects.
8. AI-Generated Features
Certain features (such as the AI Sequence Generator) use OpenAI or similar GDPR-compliant providers.
By using these features, you acknowledge that:
AI outputs are automatically generated and may not be accurate, safe, or appropriate;
You are solely responsible for the content and use of any AI-generated sequences;
Prompts violating safety or content standards may be restricted;
AI interactions are processed in real time and not stored or used for model training;
Providing text inputs to the AI is voluntary.
9. Intellectual Property
All app content, firmware, light sequences, and branding are the property of Medalite, Inc.
You receive a limited, non-exclusive, non-transferable license to use them for personal, non-commercial purposes.
You may not copy, modify, reverse-engineer, or redistribute any part of the App or firmware.
User-generated light sequences, prompts, or creative content produced within the App remain yours, but you grant Medalite a non-exclusive license to host, store, and display that content for functionality and support purposes.
10. Termination
We may suspend or terminate your account or App access at any time for safety reasons or violation of these Terms or the Waiver.
You may delete your account at any time through Settings → Account → Delete Account or by contacting contact@medalite.io.
11. Arbitration & Dispute Resolution
Any dispute arising out of these Terms or the Waiver shall be resolved by binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules, conducted in Salt Lake County, Utah.
You waive any right to participate in class actions or class-wide arbitration.
This clause does not prevent you from filing small-claims actions or claims that cannot legally be arbitrated.
12. Governing Law
These Terms and the Safety Waiver are governed by the laws of the State of Utah and, where applicable, the corporate laws of Delaware, without regard to conflict-of-law principles.
For any non-arbitrable matters, you consent to exclusive jurisdiction in Utah County, Utah.
13. Updates
We may update these Terms periodically.
Updates will be posted in the App and at medalite.io/terms.
Continued use of the App after updates means you accept the revised Terms.
